1. Agreement and eligibility
By accessing or using the site, you agree to these Terms, the Privacy Policy and, when you submit information, the Contribution Consent. If you do not agree, do not use the site. You must be at least 18 years old and legally able to enter this agreement.
2. Information service—not medical care
Discretionary Health provides research, price transparency, market intelligence and advisory services. The site does not provide medical diagnosis or treatment, prescribe medications, establish a clinician-patient relationship, or replace advice from a qualified professional. The Medical Information Disclaimer is incorporated into these Terms.
3. Data limitations
Prices, offerings, staffing, licensure, availability, accreditation and other facts can change without notice. Sources may be incomplete, inconsistent or wrong. Dates and provenance indicate what we reviewed, not a promise that a fact remains current. Comparisons may exclude taxes, travel, shipping, consultations, follow-up care, membership requirements, discounts, insurance effects and other costs unless expressly stated.
Provider inclusion, omission, order or evidence status is not an endorsement, certification or guarantee. Users remain responsible for confirming facts and making their own health, financial and purchasing decisions.
4. Permitted use
You may use public pages for your own personal or internal business evaluation. Unless we agree in writing, you may not:
- scrape, crawl, harvest, bulk download or systematically copy the site or its data;
- circumvent access controls, private-report protections, paywalls, rate limits or technical safeguards;
- resell, republish, license or use our data to build a competing directory, benchmark, model or commercial product;
- misrepresent data, remove provenance or dates, or imply our endorsement;
- probe the service for vulnerabilities, disrupt its operation or submit malicious content; or
- use the service in violation of law or another person’s rights.
Authorized API, MCP, export and enterprise access is governed by the applicable written order or data license.
5. Contributions
You are responsible for the accuracy and lawfulness of information you submit and for having permission to share it. Do not submit patient-identifying information, stolen materials, confidential information you are not authorized to disclose or content that infringes another person’s rights. Contributions are reviewed under the Contribution Consent; submission does not guarantee publication, correction, attribution or any particular assessment.
6. Intellectual property
The site, its design, taxonomy, compilation, analysis, original text, benchmarks and other materials are owned by or licensed to Discretionary Health and protected by applicable law. Provider names and third-party marks belong to their respective owners. Limited use under these Terms does not transfer ownership.
7. Third-party services
Links and references to providers, laboratories, pharmacies, platforms and other parties are supplied for context. We do not control their services, privacy practices, claims or availability and are not responsible for transactions between you and a third party.
8. Disclaimers and limitation of liability
The site and its content are provided “as is” and “as available.” To the maximum extent permitted by law, Discretionary Health disclaims implied warranties, including merchantability, fitness for a particular purpose, noninfringement and accuracy.
To the maximum extent permitted by law, Discretionary Health and its officers, employees, contractors and affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits or data, personal injury arising from reliance on site content, or third-party products and services. Nothing in these Terms excludes liability that cannot lawfully be excluded.
9. Changes, suspension and governing law
We may change, suspend or discontinue features and may update these Terms by posting a revised effective date. Continued use after an update means you accept the revised Terms. These Terms are governed by the laws of Colorado, without regard to conflict-of-law rules, and disputes will be brought in the state or federal courts located in Colorado unless applicable law requires otherwise.
